Beyond legally ending a marriage, there are many legal issues that must be resolved in any divorce case. Whether your divorce will be a contested divorce or uncontested divorce depends on whether you and your spouse can agree on the following issues:
Child Custody: Where will the child live most of the time? How will visitation be arranged? Who will make the major decisions about the child's life? Where will the child go to school?
Child Support: Which parent will pay support to the other parent? How much child support is appropriate? Who will provide medical insurance? Who will claim child tax credits and when? Who will pay for daycare? Private school? College? Who will pay for uncovered medical expenses? How and when will child support be paid?
Alimony: Is alimony appropriate in your case? Who should pay alimony? How much alimony? How long should alimony be paid? How and when will alimony be paid?
Division of Assets and Property: Who will keep the car, house, etc., or will you sell it? Who will keep the money in the bank? How will the retirement fund be split? What property is non-marital? What about that inheritance you received from your parents? The engagement ring?
Division of Debts: Who will pay the credit card bills? The mortgage and car loan? What about student loans? What about debts from before the marriage or after separation? Who will pay the lawyers?
As you can see, there are a lot of issues that must be resolved in a divorce case. If you and your spouse can agree to everything, then you can get an uncontested divorce. Otherwise, the decisions will be made either in mediation or by a judge in the family court. In either case, you should have a divorce attorney on your side that will guide you through the process and ensure that your rights are protected before the divorce is final.
