During these tough economic times it is more important than ever to have a clean record. Employers, schools, and even apartment complexes will check your criminal background before accepting your application. Sealing or expunging may be an option if you have been previously arrested or charged with a crime. Sealing or expunging may offer you a second chance at a clean criminal record.

Sealing a Criminal Record Vs. Expunging a Criminal Record

Sealing a criminal record means that the record still exists but it is sealed from public disclosure and only certain Governmental Agencies will have access to it. This means that in an ordinary criminal background check the arrest or charge will not be disclosed. Sealing is available one time to individuals that have been charged with a crime but adjudication of guilt was withheld.

Expunging a criminal record means that the criminal record is destroyed and no longer available for viewing. There will be a record of the expunging but it will not be disclosed under ordinary criminal background checks. Expunging is available to people that have been arrested or charged with crimes but the charges were not filed, were dropped or dismissed prior to trial, or resulted in a full acquittal.
